Cause and Effect: Does a settlement loan affect your case?

by DerekD on January 1, 2010

Some people who really need quick cash in a long lawsuit actually don’t apply for settlement loans, thinking it will affect the case in some way, should the opposing company or parties hear about it.

That is not the case at all. Legally, a case cannot be treated or processed differently if you apply for and/or get a settlement or pre-settlement loan.  So there’s no worries there. In fact, lawyers sometimes prefer this for a long case, that way they don’t have to be worried about their client’s financial woes while litigating a case or be forced to settle for less because a client is needing money to survive.

It will not in any way affect the outcome of a case, and lawyers (and judges) are taught not to even reference these sorts of things in the courtroom itself. So you can safely fufill your financial obligations and not worry about your current lawsuit being affected in any way.
